6. Financial restrictive measures - Tasks of the Hungarian Financial Intelligence Unit
According to the Government Decree 314 of year 2006 on the structure of the Hungarian Customs and Finance Guard and on the assignment of some of its organs the Central Criminal Investigative Bureau of the Hungarian Customs and Finance Guard has the function and competence to enforce financial restrictive measures. Kit. contains detailed regulation on the enforcement of financial restrictive measures. The close connection between the fight against financing of terrorism and the enforcement of financial restrictive measures provides the need to allocate both tasks at the same authority. The list of individuals and entities subject to financial restrictive measures ordered by the European Union is continuously changing. The service providers, the authorities running property registration and the HFIU have the task to screen and to perform a permanent monitoring activity whether the individual or entity is a subject to financial restrictive measures. Taking into account the fact that the lists of financial restrictive measures are often deficient, the HFIU - respecting the rules of data protection - is also entitled to use information received from foreign FIUs, besides checking data in its own database and other directly available databases according to 7-9. § of the Kit. If the HFIU determines that the certain individual or entity is subject to financial restrictive measures ordered by the European Union, it forwards the collected data to the competent county (capital) court and initiates freezing measure on the property. The court has to make a decision upon carrying out the freezing measure in a non-trial procedure. |
